Hi everyone,

Can anyone please provide me with any advice on copyright issues? We've had a few emails from a guy in the states wanting to claim one of the domains we have for our training services and we'd like to discuss our options & find out what we should be doing.

Thanks in advance,

Taz

Hi Taz, is he questioning copyright of part/all of the content on your site or your actual domain name? I'm not an expert, but if it's the latter, I'm pretty sure that he has no 'rights' over this. You own it and that's it. But I'm sure there's others on here that can provide a more definitive answer.

Karen may be worth talking to? http://www.4networking.biz/Members/Details/41990

Is it copyright or ownership of the domain as Paul asks?

Also don't reply to them just yet until you get all the info you need.

It's about our training division - LimeStripes. At the moment, we only have it running as a Facebook page, but registered the domains to be safe. This guy has a graphics/digital design company in the states and he's calling it Lime Stripes. Reckons there'll be an issue if we're in similar lines of work (which we are - much if our training revolves around branding/design/marketing/social media) as he's currently pursuing copyright for the Lime Stripes name.

Does that help?

Taz, obviously the IP lawyers will give you the official line, but if you've registered and clearly own the domains then that's cut and dried.

If you were trying to pass yourselves off as his company, that would be an issue, but if he's still thinking about it and hasn't actually started yet, that can't be the case. In fact you've got an arguement in reverse, he could be following you.

He's probably just peeved that you've got the domains, but that's his hard luck, unless you want to sell them for a large sum of course.

Though there may be some IP issues it won't be copyright,, the only issue really is if he registered the trademark and did so before you started using it. The best thing is to get up a web page even if one page showing you are using the name and not just holding on to it. Its your business' name too and the only way a domain can really be taken from you normally is if you have registered a name in order to try and make a profit on it, a web page with your branding will show this is not the case.
